Punchcard LLC ("Punchcard," "we," "us," or "our") operates the website thepunchcard.ai and the Punchcard service, a hiring and recruiting platform with an AI phone assistant ("Amber"). Job seekers apply to hourly roles through Punchcard, and Punchcard helps employers screen, interview, and onboard those applicants. Applicants who apply through Punchcard receive calls and text messages from Punchcard about their application. This Privacy Policy explains what information we collect, how we use it, and the choices you have. We are based in Phoenix, Arizona, USA.
We do not sell or share your mobile / SMS opt-in data for marketing
No mobile information or SMS opt-in / consent data will be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Any sharing of information with third parties is limited to what is necessary to provide the service (for example, our SMS carrier and other service providers/subprocessors that deliver messages on our behalf) and is never for those third parties' own marketing.
1. Who we are
Punchcard LLC is the platform you apply through and the data controller for information processed through the thepunchcard.ai website and the Punchcard service. When you apply to a job through Punchcard, Punchcard — not the individual employer or location — is the party that contacts you by call and text about your application. 2. Information we collect
- Applicant information — the name, mobile phone number, email address, and availability you provide when you apply to a job through Punchcard, plus the information you share during screening and interviews and the information needed to prepare employment paperwork on hire (for example, the I-9, W-4, and E-Verify).
- Application call and message data — phone numbers, call recordings and transcripts, and the texts we exchange with you about your application (application received, status updates, interview invitations and reminders, follow-ups).
- Consent records — a record of your SMS consent (the exact language you agreed to, the date and time, and, where available, IP address) when you opt in to receive texts from Punchcard about your application.
- Employer account information — the name, business/store name, email, phone number, and billing details an employer provides when they sign up or request a demo to post jobs and receive applicants.
- Usage and device data — basic technical information such as IP address, browser type, and pages visited, collected automatically when you use our website.
3. How we use information
- To operate the Punchcard hiring platform and accept and process job applications.
- To contact applicants from Punchcard about an application they submitted — by call and by transactional text such as an application-received confirmation, application status updates, and interview invitations and reminders.
- To screen and interview applicants and prepare onboarding paperwork once an applicant is hired.
- To provide the platform to employers, bill for the service, provide support, and communicate with account owners.
- To detect, prevent, and address fraud, abuse, spam, and security issues, and to comply with legal obligations.
4. How we share information
We do not sell your personal information, and we do not share SMS opt-in data or consent with third parties for their marketing. We share information only as follows:
- Service providers / subprocessors — companies that help us run the service (for example, our telephony and SMS carrier, cloud hosting, and payment processing), strictly to perform services for us and limited to what is necessary to provide Punchcard.
- The employer you applied to — the application information you submit through Punchcard is made available to the employer / location whose role you applied for, so they can consider your application and make a hiring decision.
- Legal and safety — when required by law, legal process, or to protect the rights, property, or safety of Punchcard, our customers, or the public.
- Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Privacy Policy.
5. SMS / Text messaging — Punchcard hiring notifications
Program name: Punchcard hiring notifications. When you apply to a job through Punchcard and opt in, Punchcard sends you text messages about your application. Message types include: application received, application status updates, and interview invitations and reminders. Message frequency varies. Message and data rates may apply. Reply HELP for help; reply STOP to opt out. You may also get help by contacting support@thepunchcard.ai. Mobile carriers are not liable for delayed or undelivered messages.
We do not sell or share mobile information / SMS opt-in data with third parties for marketing. Your mobile information and SMS opt-in / consent data will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. The mobile phone number and SMS consent you provide are used only by Punchcard to text you about your application and are not shared with the employer for marketing. Opting in to texts is optional and is not a condition of applying or being considered for any job.
6. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, or misuse. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
7. Applicant data handling and retention
We handle applicant information to operate the hiring process described above and retain it for as long as needed to consider your application, to support hiring and onboarding if you are hired, to comply with our legal obligations, resolve disputes, and enforce our agreements. We keep your SMS consent and opt-out records for as long as required to document your consent and honor your choices. When information is no longer needed, we delete or de-identify it. You may ask us to delete your applicant information by contacting support@thepunchcard.ai.
8. Your rights and choices
Depending on where you live, you may have the right to access, correct, delete, or port your personal information, or to object to or restrict certain processing. You can opt out of Punchcard hiring texts at any time by replying STOP. To exercise any of these rights, contact us at support@thepunchcard.ai.
9. Children's privacy
Punchcard is not directed to children under 13 (or under 16 where applicable), and we do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the service after changes take effect constitutes acceptance of the updated policy.
